This Participant User Agreement (“Agreement”) is made by NADP:National Association of Divorce Professionals )”NADP”) with the person downloading, using, or accessing a NADP e-Learning program (“Training”), including but not limited to the Certified Divorce Specialist (CDS™) Training, and other copyrighted materials made available to the registered user (“Participant” or “You”).
1. Binding Terms and Changes:
By becoming a registered user of the Site, by clicking the “I Accept” button on this registration page, and by using the Training, You acknowledge that You have read and understood this Agreement, and You agree to be bound by all of the terms and conditions of this Agreement. NADP may change the terms of this Agreement from time to time. Any changes to this Agreement will be posted on the Site and will become effective and be binding on You immediately upon posting. NADP may also change the terms by notifying you by any other reasonable form of notification, effective immediately upon notice being provided. Your continued use of the Training following such notice constitutes Your acceptance of those changes.
2. Password Use and Security:
By entering into this Agreement, You acknowledge that the Training is for Your exclusive use only. Use or sharing of Your User Name and Password by another user is not permitted and is cause for immediate termination of this Agreement without notice to You.
You are solely responsible for maintaining the confidentiality of Your User Name and Password and for all activities that occur under Your User Name and Password. You agree to immediately notify our Customer Service Department if You become aware of or have reason to believe that there is any unauthorized use of Your account or any other breach of security. You also agree to take all reasonable steps to stop such unauthorized use and to cooperate with NADP in any investigation of such unauthorized uses or of infringements of NADP’s intellectual property rights in the Training. NADP shall have the sole right, at its expense, to bring any action on account of such infringements or unauthorized uses. NADP is in no way liable for any claims related to the use or misuse of Your User Name and Password due to the activities of any third party outside of our control or due to Your failure to maintain their confidentiality and security.
3. Use of the CDS™ On-Demand Course:
NADP grants to its registered users non-transferable, non-exclusive, and revocable access the CDS™ On-demand Course. Training is solely for Participant’s personal/professional development, noncommercial use; you may not use the Training in any way in exchange for monetary consideration. Individuals other than the Participant may not access or view this course or view/use supporting materials, whether electronically or in print. The Participant is permitted online access to the Training and may download, save, or print one hard copy of the CDS™ Training Manual, or other information from the Training solely for the personal, noncommercial use of the Participant. The Participant may only use this online access in a way that conforms to all applicable laws and regulations. Except as expressly granted by this Agreement, You acquire no right, title or license in the Training or the content or other data or materials incorporated in the Training and may not sublicense, sell, or resell the whole or any part of the Training or its contents. Except as expressed granted by this Agreement, You may not reproduce, transmit, distribute, or use the Training or the content or other data or materials incorporated in the Training without NADP’s permission. You may not commingle any portion of the Training with any other information and shall not edit, modify, or alter any portion.
Any violation of this Agreement or abuse of the policies of the Training will result in the immediate and permanent cessation of access to the CDS™ Program and will be pursued to the fullest extent permitted under all applicable laws, treaties, and conventions.
As a participant in the CDS™ Aligned Pilot Program, upon completion of the CDS Training, I agree to complete follow up quarterly surveys, in a timely manner, that will be provided to me by the NADP for a period of up to one-year. If I do not complete the surveys within 30 days of receiving them, I will no longer be eligible to be part of the CDS™ pilot program, and NADP will have the right to revoke any CDS™ designation provided to me.
4. Copyright:
Certified Divorce Specialist (CDS™) Courses are copyrighted © 2019 by NADP:National Association of Divorce Professionals in the United States of America. While NADP grants You the nonexclusive and limited right to use the Training as set forth in this Agreement, NADP reserves all rights on the basis of the Copyright law. All written material issued by the National Association of Divorce Professionals in the Training are strictly for the exclusive use of the participant and may not be copied, published, or shared with third parties, unless with the advance permission of the NADP. Training participants are not allowed to make sound or video recordings during the training. You agree to not share content and course materials from the classroom, online training, or online resources with non-registrants. All content provided is off-limits to everyone but enrolled students and staff. Course materials, including but not limited to the seven stages of the professional/client session cycle, may not be copied or added to other courses provided by participants. A printed course manual is provided only for Hybrid and In-person CDS trainings. On-demand participants have access to a digital copy of the manual. You acknowledge that NADP is the sole and exclusive owner of the entire copyright and other proprietary rights in and to the Training and in and to the content and other data and materials incorporated in the Training. All uses of the Training are subject to NADPs copyright and other intellectual property rights.
Photography and Video Release: I hereby grant permission to the rights of my image, likeness, and sound of my voice as recorded on audio or video without payment or any other consideration to the National Association of Divorce Professionals. I understand that my image may be edited, copied, exhibited, published, or distributed, and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the settings within an unrestricted geographic area. By signing this form, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in a public educational setting. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. By signing this form, I acknowledge that I have completely read and fully understand and above release and agree to be bound thereby. I hereby release any and all claims against the person or organization utilizing these materials.
5. Fees and Payments for Course Registration:
As part of the CDS™ Aligned Corporate Pilot Program, there is no fee to participate in the Certified Divorce Specialist (CDS™) On-demand Course. Upon passing the assessment with a grade of 75% or greater the CDS™ designation may or may not be provided to you based on professional criteria. Proof of the profession listed on the registration form might be requested. If the participant does not have proof of licensing, credentials, or experience in the profession listed, the National Association of Divorce Professionals reserves the right to deny the participant use of the CDS designation. If you are approved to receive the designation it will be valid for one year at no cost to you. Thereafter, designations may be renewed yearly for $95. Ten (10) hours of divorce-specific CE credits must be submitted every two (2) years to maintain designation. After designee submits first renewal $95 payment (12 months after passing the assessment), all future yearly renewals will be automatically processed. If designee does not want to renew, they must email
[email protected] a request for cancellation at least 30 days prior to renewal date so that they will not be automatically charged.
6. Limitation of Liability:
In no event shall NADP, its affiliates, directors, officers, employees, agents be liable to you or to any third party for any special, incidental, indirect, consequential, or punitive damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability (whether in contract, tort or otherwise), arising out of or in connection with the use or performance of the training or the content therein.
The service is provided “as is,” and you rely on the training and its contents at your own risk. There are no representations or warranties of any kind, either express or implied, including, but not limited to: No representations or warranties of merchantability or fitness for a particular purpose; no representations or warranties as to the accuracy or completeness of the service; and no representations or warranties that the service or anything else provided pursuant to this agreement will not infringe proprietary rights of third parties.
Participant understands that NADP e-Learning is for educational purposes only.
